Fact Lease Broker Terms (27 Sep 2026)
These are the terms a Texas broker accepts, in the private editor, before sending a firm page to Fact Lease for review. There is no fee, commission, or exclusivity. Reading this page doesn't sign you in or open anyone's page.
The short version
- Your page is your firm's advertisement. You're responsible for what it says.
- You may advertise every listing you add, and you own or may publish every photo.
- Fact Lease is not a brokerage and does not represent anyone.
- Reader inquiries go straight to you. Fact Lease keeps a log entry, not the message.
- Listings you don't reconfirm every 30 days hide automatically.
- You can edit the page anytime. To take it down, email robert@factlease.com (or reply to any Fact Lease email); it comes off within 5 business days.
The full terms
These terms cover your broker profile on Fact Lease and everything you submit to it: firm details, team members, listings, photos, closed deals, and documents. "We" and "Fact Lease" mean Fact Lease. "You" means the licensed Texas real estate broker named on the profile and anyone who submits content for that broker. By checking the box in the editor, you agree to these terms for yourself and for the broker.
1. What Fact Lease is
Fact Lease publishes dated records of observed asking rents for commercial space in Texas. Fact Lease is not a real estate brokerage. It does not represent landlords, tenants, buyers, or sellers. It does not negotiate, show property, or take part in any transaction. Your profile is your advertisement, and Fact Lease hosts it. You and your broker remain responsible for it under the Texas Real Estate License Act and the TREC rules.
2. Who may submit
You confirm that:
- the broker named on the profile holds an active Texas real estate broker license, or is an entity with an active license and a designated broker;
- you are that broker, the designated broker, or a person the broker has authorized to publish this profile and each item on it; and
- the broker supervises what you publish.
We may ask for proof of any of this. We may pause the profile until we have it.
3. Your authority to advertise each listing
For every listing you submit, you confirm that the firm has authority to advertise it on the terms shown. That means one of these is true:
- the firm is the listing broker;
- the firm has the consent of the owner or the owner's authorized agent; or
- another broker holds the exclusive listing and gave permission. In that case you name that broker on the listing, unless they have waived that disclosure in writing.
You will change a listing's status or remove it promptly when it is no longer available, and in any case within 10 days after the listing agreement ends. After a transaction closes, you will show it as leased or sold with the date, or remove it. We may hide listings you have not reconfirmed within the period shown in the editor.
4. Photos and other uploads
For every image, floor plan, logo, or document you upload, you confirm that the firm owns it or is licensed to use it this way. You also confirm that anyone shown in a photo has agreed to its use.
You grant Fact Lease a non-exclusive, royalty-free, worldwide license to host, copy, resize, crop, format, and display each upload on your profile, on listing pages and cards that are part of your profile, and in previews of your profile, such as link previews and search results. We do not sell your uploads. We do not use them in other brokers' profiles. We do not use them in Fact Lease advertising without asking you first.
You may remove an upload at any time in the editor, or by asking us. We will take it off public pages within 5 business days. Copies can remain in backups until the backups roll off, and they are not public.
If someone tells us an upload infringes their rights, we may remove it and tell you.
5. Accuracy
You are responsible for the accuracy of everything you submit. That includes rents and rent basis, sizes, availability, status, names, titles, license information, closed-deal claims, and your roles in those deals. You will not submit anything misleading.
In particular, you will not:
- claim a role in a transaction the firm did not have;
- describe a sales agent as a broker or as the person running the brokerage;
- use a team name or assumed business name that is not registered with TREC;
- state the value of a specific property unless it is based on a disclosed appraisal; or
- rank the firm without disclosing objective criteria.
You will correct errors promptly when you learn of them.
6. How Fact Lease labels content
- Content you submit is labeled "Broker-submitted", with the date you submitted it and the date you last confirmed it. We do not present it as something Fact Lease observed or verified.
- Fact Lease's own records are labeled "Observed by Fact Lease", with the date and the public source where available.
- The "Market data by Fact Lease" panel on your profile shows Fact Lease's published asking-rent figures. It is Fact Lease's content, not yours. It is not an appraisal or an opinion of any property's value. You may not change it. You may ask us to turn it off on your profile.
7. Public listing URLs and the Fact Lease ledger
When you submit a listing, you may give us a link to a public web page for the same space, such as your firm's page or a public listing site. If you do, you agree that Fact Lease may read that public page and add a dated observation to its public ledger. The observation records only what the public page itself states, such as the address, the suite, and a stated asking rent with its unit. It is labeled with the date and the source address.
- We do not copy your photos or marketing text into the ledger.
- We do not add anything the public page does not state.
- A ledger observation is a historical record of what a public page said on a date. It can stay in the ledger after you remove the listing from your profile.
- If you believe an observation misreads the page, use the corrections process at factlease.com/corrections.
- If the page was never meant to be public, email us and we will review it.
8. Our review; declining or removing content
Profiles, listings, and changes go live only after Fact Lease approves them. We may decline, hide, or remove any profile or item, with or without notice, if:
- we cannot verify the license or your authority;
- it appears inaccurate, misleading, out of date, or infringing;
- it does not meet TREC advertising requirements as we understand them;
- we receive a credible complaint; or
- we otherwise decide not to host it.
Approval does not mean we have verified the content. It also does not make Fact Lease responsible for your advertising. We may also make formatting changes, such as resizing, cropping, and layout. We do not rewrite your content.
9. Required Texas disclosures
Your profile shows your broker name. It also shows links titled "Texas Real Estate Commission Information About Brokerage Services" and "Texas Real Estate Commission Consumer Protection Notice", plus a statement that Fact Lease is not a brokerage. You must upload or link your completed current IABS form, IABS 1-2 as of 2026, and keep it current. We place these items in fixed positions. You cannot remove them. They are not a substitute for your own compliance review.
10. Reader inquiries
The inquiry form on your profile sends each inquiry to the email address you designate. Fact Lease does not respond to, screen, qualify, rank, or follow up on inquiries. It does not send them to anyone else, and it does not sell them.
- We do not keep a copy of any inquiry. The sender's name, contact details, and message go straight to your designated email and are not stored by Fact Lease.
- We keep only a delivery record for each inquiry: the time, the broker it was for, and whether delivery succeeded, plus a one-way hash of the sender's IP address for abuse prevention.
- You will use inquiry details only to respond to that person and to provide your services. You will follow the laws that apply to contacting them, including anti-spam and telemarketing laws.
- You will keep your designated email working.
11. No fee; no referral fees
The profile is free. Fact Lease charges no fee for the profile, for listings, or for inquiries.
Fact Lease does not accept, and you will not offer, any commission, referral fee, lead fee, or other payment tied to a lease, sale, or other transaction. If Fact Lease ever offers paid features, it will describe them separately, and you will have to agree to them separately. These terms never create a fee.
12. Your data; retention and deletion
We keep your profile content while your profile is active, plus the account and acceptance records needed to show who submitted what and when.
You may ask us to unpublish or delete your profile, or any part of it, at any time. We will:
- take the requested content off public pages within 5 business days; and
- delete it from our active systems within 30 days, except for:
- records we must keep for legal or dispute purposes: submission and acceptance logs, and approval decisions;
- backups, until they roll off; and
- ledger observations described in section 7.
13. No warranty; responsibility
Fact Lease provides the profile "as is", without warranties. To the extent the law allows, Fact Lease is not liable for:
- indirect or consequential losses, or lost commissions or deals;
- outages; or
- errors in content you submitted.
You will be responsible for, and will defend Fact Lease against, claims caused by content you submitted or by your breach of these terms. This includes claims of copyright infringement, of advertising without authority, and of inaccurate listing information.
14. Changes and ending
We may update these terms. We will email the designated address at least 14 days before a change takes effect. If you do not accept the change, you can unpublish your profile. Either side may end this arrangement at any time. Sections 4 (licensed uses until content is removed), 7, 12, and 13 survive.
